United States federal courts have delivered a major legal victory to Delta Air Lines and Grupo Aeroméxico, ruling to officially annul the government directive that threatened to dismantle their decade-long commercial partnership. The judicial decision halts attempts by federal regulators to strip the carriers of their vital antitrust immunity.
The U.S. Court of Appeals for the Eleventh Circuit determined that the previous administrative ruling issued by the Department of Transportation (DOT) was legally flawed. According to the court's opinion, the regulatory body acted in an arbitrary and capricious manner by failing to provide a reasonable explanation for implementing a much more restrictive market analysis than historically applied in similar aviation joint ventures.
The underlying regulatory dispute originated when authorities claimed that the partnership provided an unfair market advantage on trans-border routes, pointing specifically to operational constraints at the Benito Juárez International Airport in Mexico City. However, legal representatives for the airlines successfully argued that regulators improperly focused on localized airport constraints rather than evaluating the broader, competitive U.S.-Mexico aviation market as a whole.
With the judicial block successfully lifted, both carriers retain their antitrust immunity, ensuring the uninterrupted continuation of their joint operations, code-sharing programs, and frequent flyer benefits.
